2. Joint Controllership (Article 26 GDPR)
In connection with the use of the LinkedIn Page Analytics function (also referred to as “Page Insights”), LinkedIn and IHK Düsseldorf jointly process personal data.

- LinkedIn is primarily responsible for the processing of users’ personal data on the platform, including ensuring data security and fulfilling data protection information obligations.
- IHK Düsseldorf receives only aggregated, statistically prepared evaluations regarding the use of the LinkedIn presence and cannot draw any conclusions about individual persons.
- LinkedIn assumes primary responsibility for fulfilling data subject rights. IHK Düsseldorf is supported by LinkedIn if data subjects exercise their rights.
Irrespective of this, data subjects may exercise their rights against both LinkedIn and IHK Düsseldorf.
3. Processing of Page Analytics Data
LinkedIn provides IHK Düsseldorf with statistical information on the use of the LinkedIn presence within the scope of Page Analytics. This includes, in particular, information on:
- reach of posts (impressions),
- page views,
- interactions (e.g. clicks, likes, comments),
- development of follower numbers.
These data constitute aggregated information that cannot be directly attributed to individual persons. IHK Düsseldorf has no possibility of identifying individual users or assigning the data to specific LinkedIn profiles.
However, it is possible that LinkedIn processes personal data of persons who do not themselves have a LinkedIn profile in the course of providing these statistics.

4. Purposes and Legal Basis of Processing
IHK Düsseldorf processes the Page Analytics data provided by LinkedIn for the following purposes:
- evaluation of the reach and use of the LinkedIn presence,
- needs-based design and optimization of the published content,
- support of public relations activities and information services for member companies and the interested public.
The legal basis for this processing is Article 6(1)(e) GDPR in conjunction with Section 1(1) of the German Act on Chambers of Industry and Commerce (IHKG) (performance of a task carried out in the public interest or in the exercise of official authority).
The processing is necessary in order to properly perform the statutory tasks assigned to IHK Düsseldorf, in particular in the area of information and public relations. The interests of the data subjects are safeguarded by the fact that the evaluation is carried out exclusively in aggregated form and that no personal profiles or individual analyses are created.
5. Interaction with the LinkedIn Presence
If you are logged in with your LinkedIn profile and interact with our LinkedIn presence (e.g. by liking, commenting on or sharing posts), the data visible in this context (e.g. user name, profile picture, published content) will be processed by IHK Düsseldorf.
This processing is carried out in order to enable communication with users and to optimize content and its presentation.
The legal basis is Article 6(1)(e) GDPR in conjunction with Section 1(1) IHKG, as the processing is necessary for the performance of the statutory public relations and information tasks of IHK Düsseldorf.
6. Processing by LinkedIn and Third-Country Transfers
When visiting our LinkedIn presence, LinkedIn processes users’ personal data. This includes, in particular, the IP address as well as other information stored on users’ devices via cookies or similar technologies. This data processing is carried out by LinkedIn as the platform operator.
The personal data collected in this context may also be transferred by LinkedIn to countries outside the European Union, in particular to the United States of America, for example to LinkedIn Corporation, 1000 W Maude Ave, Sunnyvale, CA, USA.
Where personal data are transferred to the USA, such transfers are carried out on the basis of the European Commission’s adequacy decision pursuant to Article 45 GDPR for the EU-U.S. Data Privacy Framework (DPF), provided that the respective recipient – in particular LinkedIn Corporation – is certified as an active participant under the Data Privacy Framework (according to the official DPF list).
Where and insofar as individual transfers are not covered by the scope of the Data Privacy Framework, the transfer is carried out on the basis of appropriate safeguards pursuant to Article 46 GDPR, in particular by concluding Standard Contractual Clauses of the European Commission.
Notwithstanding the safeguards mentioned, it cannot be ruled out that U.S. authorities may access personal data within the scope of their statutory powers.

In the event of an objection, IHK Düsseldorf will no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.
